Šio darbo tyrimo tikslas yra patvirtinti arba paneigti hipotezę, jog Europos arešto orderio sistema, dėl tradicinės ekstradicijos principų dalinio atisakymo ir nesugebėjimo užtikrinti pagrindinių žmogaus teisių baudžiamąjame procese, pažeidžia žmogaus teises, numatytas traptautinėse sutartyse, Europos Sąjungos ir valstybių narių teisėje, analizuojant teisės mokslininkų darbus, norminius Europos Sąjungos aktus bei valstybių narių teismo sprendimus. Po 2001 m. rugsėjo 11 d. teroro aktų didžioji dalis visuomenės pradėjo žymiai jautriau reaguoti į terorizmo problemą. Didėjanti terorizmo grėsmė įpareigojo pasaulio valstybes imtis skubių priemonių, siekiant pažaboti tarptautinį nusikalstamumą. 2002 metais Europos Taryba priėmė Pagrindų sprendimą dėl Europos arešto orderio ir asmenų perdavimo tarp valstybių narių, turėjusį pradėti naują etapą Europos Sąjungos baudžiamojo bendradarbiavimo srityje. Pagrindų sprendimas teisiškai reglamentavo įtariamųjų ar nuteistųjų perdavimą tarp valstybių narių, remiantis išimtinai teisiniu bendradarbiavimu bei abipusio pripažinimo principu. Pagrindų sprendimas pakeitė prieš jo priėmimą sudarytų daugiašalių sutarčių dėl asmenų perdavimo tarp valstybių narių atitinkamas nuostatas. Šio darbo tyrimo objektas - Europos arešto orderis - iš dalies ar visiškai panaikino daugelį ekstradicijos sutartyse dažniausiai sutinkamų principų ir taisyklių, saugančių įtariamo ar nuteisto asmens teises. Šių „saugiklių“ buvo atsisakyta siekiant pagreitinti asmens perdavimą baudžiamojo bendradarbiavimo tikslais bei užkirsti kelią piktnaudžiavimui savo teisėmis – iš dalies tradicinių ekstradicijos taisyklių buvo atsisakyta remiantis abipusio pripažinimo principo ir laisvės, saugumo bei teisingumo erdvės įgyvendinimu Europos Sąjungoje. ; The aim of this work is by means of analysis of works by legal scholars, the regulatory framework of the European Union and the judicial decisions of the Member States to confirm or refute the hypothesis that due to narrowed principles of the traditional extradition and inability to ensure basic human rights in criminal proceedings, the European arrest warrant system violates human rights guaranteed by international treaties, the European Union and national legislation. After the terrorist attack on September 11, the majority of society started to pay more attention to the problem of terrorism. Faced with the growing threat of terrorism, countries of the world are bound to take fast measures against international crime. In 2002 the European Council adopted the Framework Decision on the European Arrest Warrant and extradition procedure between member states which was supposed to start a new stage in the criminal cooperation in the European Union. The Framework decision legally regulated the extradition of convicted or suspected people between Member States on the grounds of exclusively judicial cooperation and the principle of mutual recognition. The Framework decision has also changed the principles of multilateral agreements related to extradition procedure between Member States. The target of this research, the European arrest warrant, has partially or entirely eliminated most of the principles and rules of extradition agreements, which were supposed to defend the rights of a convicted or suspected person. These “safeguards” were removed in order to make an extradition procedure faster and to prevent the offenders from abusing their rights; traditional extradition rules were partially eliminated based on the principles of mutual recognition and implementation of freedom, security and justice area in the European Union. ; Vytauto Didžiojo universitetas
