La Convención Americana sobre Derechos Humanos: Piedra angular del derecho a la vida del no nacido en Latinoamérica y el Caribe ; The American Convention on Human Rights: Cornerstone of the Right to Life of the Unborn in Latin America and the Caribbean

Los Estados parte de la Convención Americana otorgaron explícitamente protección a la vida desde el momento de la concepción en el artículo 4(1), protegiendo al niño no nacido, como sujeto de derechos, de cualquier acto que intencionalmente cause su muerte o destrucción. Si bien la Corte Interamericana ha sido benevolente frente a esta disposición, la Comisión Interamericana de Derechos Humanos ha sido inconsistente en su aplicación, variando su posición al respecto a través de las últimas décadas, promoviendo en ocasiones la legalización del aborto o su reconocimiento como derecho humano. Sin embargo, una correcta interpretación del artículo 4(1) por parte de la Comisión o la Corte aplicaría las normas internacionales de interpretación de los tratados y concluiría que la Convención protege la vida del niño no nacido contra todo tipo de aborto voluntario o tecnologías reproductivas que atenten contra su vida y que los Estados parte tienen no sólo la obligación de garantizar este derecho sino de prevenir violaciones al mismo. ; States parties to the American Convention granted explicit protection to life from conception in article 4(1), protecting the unborn child, as subject of human rights, against any acts that intentionally cause his death or destruction. Although the Inter–American Court of Human Rights has had a benevolent approach to this provision, the Inter–American Commission on Human Rights has been inconsistent in its application, changing its position throughout the last decades, occasionally promoting the legalization of abortion or its recognition as a human right. However, a correct interpretation of arti- cle 4(1) by the Court or the Commission would apply international norms of treaty interpretation and conclude that article 4(1) supports the unborn child’s protection from all forms of elective abortion or reproductive technologies that attempt against his life and that states parties have not only a duty to enforce this right but to prevent violations thereof.
