Przedmiotem niniejszej glosy jest ocena stanowiska zajętego przez Sąd Okręgowy w Warszawie w wyroku z dnia 9 lipca 2021 r. (X GC 114/20). W orzeczeniu tym sąd oddalił roszczenie powódki o naprawienie (poprzez zasądzenie na jej rzecz stosownego odszkodowania) szkody wyrządzonej jej wskutek naruszenia prawa konkurencji (przez pozwaną). Glosa w dużej mierze krytycznie odnosi się do argumentacji sądu, skupiając się na zagadnieniach dotyczących przedawnienia wspomnianego roszczenia (zatem przede wszystkim interpretacji art. 442 1 § 1 k.c.). Warto podkreślić, że w ocenianej sprawie bezspornym był fakt samego dopuszczenia się (przez pozwaną) wspomnianego naruszenia (gdyż stwierdzone ono zostało w decyzji Prezesa UOKiK). ; The subject matter of this gloss is the assessment of the position taken by the Regional Court in Warsaw in its judgment of 9 July 2021 (X GC 114/20). In that judgment, the court dismissed the applicant’s claim for compensation (by awarding it appropriate compensation) for the harm caused to it as a result of the infringement of competition law (by the defendant). Glosa is largely critical of the court’s arguments, focusing on questions relating to the limitation of the claim (thus, above all, the interpretation of Article 442(1) of the Civil Code). It is worth pointing out that, in the present case, it was the very fact that the infringement in question had been committed (by the defendant) (as it was established in the decision of the President of the UOKiK).
