As an original means of acquiring public property rights, expropriation is an extremely powerful instrument at the disposal of state authorities, frequently used to carry out projects of national, county or local public interest, and is an essentially exceptional measure which requires a number of steps to be taken, including, first and foremost, justification of a public interest in terms of urgent need and expediency. The expropriation procedure can be implemented under two fundamental conditions, namely the declaration and justification of a public utility and the granting of fair and prior compensation, conditions mentioned in the Romanian Constitution, the Civil Code as well as Law no. 33/1994 and Law no. 255/2010. Thus, we consider that expropriation is possible only under conditions that respect and ensure compliance with the guarantees and fundamental principles existing in a state governed by the rule of law, meaning that the three powers work together to harmonize interests: the legislative with powers to regulate expropriation, the executive with powers to declare public use of works and to initiate the expropriation procedure, and the judiciary with powers to review the legality of acts issued in the context of expropriation proceedings. Therefore, in terms of the prerogatives conferred by law regarding the protection of the rights and interests of natural and legal persons to be expropriated, we consider that acts issued in the regulation and execution of an expropriation procedure, both normative and individual, can be challenged under Law no. 554/2004 of administrative litigation, which applies in addition to Law no. 255/2010, in which context the expropriation procedure may be subject to the control of legality by the courts, in order to make the existing guarantees at the level of fundamental rules more effective. Fiind o modalitate originară de dobândire a dreptului de proprietate publică, exproprierea reprezintă un instrument extrem de puternic aflat la îndemâna autorităţilor statale, utilizat de altfel în mod frecvent în vederea realizării unor proiecte de interes public naţional, judeţean sau local, fiind de altfel o măsură esenţialmente excepţională, care impune parcurgerea unor etape, printre care se numără în primul rând justificarea unui interes public din punct de vedere al necesităţii urgente şi al oportunităţii. Procedura exproprierii poate fi pusă în practică cu îndeplinirea a două condiţii fundamentale, respectiv declararea şi justificarea unei utilităţi publice şi acordarea unei juste şi prealabile despăgubiri, condiţii amintite în Constituţia României, Codul Civil, precum şi Legea nr. 33/1994 şi Legea nr. 255/2010. Considerăm astfel că exproprierea este posibilă numai în condiţii care să respecte şi să asigure respectarea garanţiilor şi principiilor fundamentale existente într-un stat de drept, sens în care cele trei puteri să conlucreze în vederea armonizării intereselor: puterea legislativă cu atribuţii în reglementarea exproprierii, puterea executivă cu atribuţii în declararea utilităţii publice a unor lucrări şi declanşarea procedurii de expropriere, iar puterea judecătorească cu atribuţii în exercitarea controlului de legalitate asupra actelor emise în contextul unei proceduri de expropriere. Prin urmare, sub aspectul prerogativelor conferite de lege în ceea ce priveşte apărarea drepturilor şi intereselor persoanelor fizice şi juridice ce urmează a fi expropriate, apreciem că actele emise în reglementarea şi executarea unei proceduri de expropriere, atât normative, cât şi individuale, pot fi contestate în temeiul Legii nr. 554/2004 a contenciosului administrativ, care se aplică în completarea Legii nr. 255/2010, context în care practic procedura exproprierii să poată fi supusă controlului de legalitate al instanţelor de judecată, în vederea eficientizării garanţiilor existente la nivelul normelor fundamentale.
