The article deals with the case law of the Cour de Cassation and the French higher courts regarding the question of whether the end buyer of a supply or contract chain can assert warranty rights against upstream suppliers or the manufacturer when the United Nations Convention on Contracts for the International Sale of Goods (CISG) applies to the first purchase contract in the chain. A case example is given of a construction company with a supplier from Italy and an intermediary in France, where the action directe was applied. The action directe allows the end buyer to hold not only their immediate seller but also all intermediaries up to the manufacturer jointly liable for warranty defects. Various legal and conflict of laws issues are discussed. It is emphasized that the action directe represents a claim derived from the original buyer and that an end buyer's action directe is excluded if the intermediary seller had knowledge of the defect. Der Artikel behandelt die Rechtsprechung der Cour de Cassation und der französischen Obergerichte zur Frage, ob der Endkäufer einer Liefer- oder Vertragskette Mängelgewährleistungsrechte gegenüber Vorlieferanten oder dem Hersteller geltend machen kann, wenn auf den ersten Kaufvertrag der Vertragskette UN-Kaufrecht Anwendung findet. Es wird ein Fallbeispiel eines Bauunternehmens mit einem Lieferanten aus Italien und einem Zwischenhändler in Frankreich genannt, bei dem die action directe angewendet wurde. Die action directe ermöglicht es dem Endkäufer, neben seinem unmittelbaren Verkäufer auch alle Zwischenhändler bis hin zum Hersteller in Bezug auf Gewährleistungsmängel als Gesamtschuldner in Anspruch zu nehmen. Es werden verschiedene rechtsdogmatische Begründungen und kollisionsrechtliche Fragen diskutiert. Es wird betont, dass die action directe einen vom ursprünglichen Käufer abgeleiteten Anspruch darstellt und dass eine action directe des Endkäufers ausgeschlossen ist, wenn der Zwischenverkäufer Kenntnis vom Mangel hatte.
